These General Terms and Conditions ("GTC") govern the contractual relationship between you and Aqua-Spa-Resorts AG¹ or Aqua-Spa-Resorts AG Thermal bath & Spa² ("AQUA-SPA-RESORTS"). They apply to all legal relationships that you enter into or establish via the online shop at aqua-spa-resorts.ch or via the websites of the individual spa worlds³ (hereinafter "websites") as well as directly on site in connection with the use of the facilities and equipment ("spa worlds") of AQUA-SPA-RESORTS.

The current version of the GTC can be found on the AQUA-SPA-RESORTS website. They are also available in printed form at the entrance to each Spa World for you to view and take away. These GTC are an integral part of every contractual relationship between you and AQUA-SPA-RESORTS.

By signing a written subscription contract, by ticking the relevant box on the website, by booking your desired service or by using the Spa Worlds on site, you confirm that you have read, acknowledged and understood the provisions of the GTC.

You must comply with the house and bathing rules of the Spa Worlds and follow the instructions of the AQUA-SPA-RESORTS staff. A copy of the house and bathing rules is available in every Spa World. In the event of serious breaches of the GTC, the house and bathing rules and/or the instructions of staff, you may be banned from the premises immediately. In such cases, payments already made may not be refunded. AQUA-SPA-RESORTS expressly reserves the right to press criminal charges in the event of misuse of the chip wristband or the annual pass.

You also note that there may be waiting times due to the limited number of places in the spa worlds.

You have the following options for your admission to the Spa Worlds:

• Admission
• Multiple entry
• Annual subscription

The admission price does not include all other services offered by AQUA-SPA-RESORTS, such as massages, care and beauty treatments, special events, etc. These additional services are recorded either on site or electronically. These additional services are recorded either on site or electronically. Your bookings are binding and will be charged upon Admission or must be paid on site at the latest when you leave the Spa World. Unused, booked or charged services do not entitle you to a refund, payment or rebooking. Delays or cancellations at short notice (less than 24 hours before the appointment) will not be refunded, credited or compensated with substitute services.

The purchase of an Admission entitles you to use the Spa World on one day for the duration defined on the ticket.

Tickets purchased online are only valid on the day booked and only for the services listed on them. A rebooking or refund is generally excluded.

Both online tickets and tickets purchased at the box office are transferable - with the exception of personal subscriptions (such as the annual subscription).

A multiple entry ticket entitles you to visit the Spa World on as many days as indicated on the ticket. Multiple entries are valid for two years from the date of issue. Admission tickets that have not been redeemed expire without replacement after this period.

An annual subscription entitles you to use the Spa World for one year from the date of issue. The annual subscription is personal and non-transferable. You must be at least 18 years old (18 years of age or older). A photo of you will be taken for a visual check. This photo will only be used for verification purposes upon Admission and will be deleted after termination or cancellation of the contract. Non-use of the Spa Worlds during the term of the annual subscription does not entitle you to a price reduction or refund. Exceptions only apply in cases of hardship, e.g. prolonged illness, accident with prolonged convalescence or a change of residence more than 30 kilometres from the relevant Spa World within the first six months of the annual subscription being issued. If the case of hardship occurs later, there will be no refund. You will only receive a refund if you cancel in writing by registered letter within this six-month period and submit the necessary proof (e.g. medical certificate, confirmation from your employer, proof from the residents' registration office, etc.). The refund is staggered:

1st month = 45% refund

2nd month = 40% refund

3rd month = 35% refund

4th month = 30% refund

5th month = 20% refund

6th month = 10% refund

A fee of CHF 50 will be deducted from the refund to cover administrative costs.

You are authorised to use the facilities and services during the published opening hours. AQUA-SPA-RESORTS may adjust its offer and opening hours at any time. If the offer or the operating hours are temporarily restricted, you are not entitled to a refund or extension of your multiple entry or annual subscription. There is also no entitlement to a refund or extension in the event of operational closures (e.g. for cleaning, refurbishment, remodelling, revisions, etc.).

You are also not entitled to a refund, compensation or replacement services if AQUA-SPA-RESORTS is unable to provide its services for reasons beyond its control (e.g. force majeure).

The contract is concluded as soon as you receive confirmation from AQUA-SPA-RESORTS of your online order (by e-mail or telephone) with the order details and these GTC. The contract is concluded on site with the purchase of the respective services or subscriptions. (Prices are subject to change.)

All prices are quoted in CHF and are gross prices including all taxes (incl. VAT). Any delivery and shipping costs as well as time-limited surcharges are to be paid separately. For payments in euros, the exchange rate on the day of payment applies. Prices are subject to change without notice.

When you enter a spa world, you will receive a chip wristband. Your entry and exit times as well as the use of services that are not included in the daily entry, multiple entry or annual subscription are recorded electronically on the chip.

You must wear the chip bracelet clearly visible in the Spa World. You are liable for any damage to or loss of the chip bracelet. You must report any loss to AQUA-SPA-RESORTS immediately. If a new chip bracelet has to be issued, a fee will be charged. Any remaining credit at the time of the loss report will be transferred to the new chip.

Vouchers from AQUA-SPA-RESORTS can be redeemed in all Spa Worlds or online. Service and value vouchers expire 10 years after the date of issue (Art. 127 OR).
Service vouchers relate to a specific, clearly defined offer. Value vouchers can be used for all services offered in the corresponding equivalent value. If the service defined in the service voucher is no longer on offer or no longer available at the same price at the time of redemption, the equivalent value will be credited towards an equivalent or different service. An exchange or (partial) refund of the voucher amount is excluded. Reduced residual amounts resulting from partial redemption are also subject to the original 10-year limitation period from the date of issue.

Discounts, concessions and Admission offers do not count as Vouchers. They can be redeemed in accordance with the applicable provisions and expire at the latest on expiry of the period stated on the Vouchers. Discounts and concessions cannot be combined.

Vouchers are available either at the ticket desk or in the online shop. When ordering in the online shop, you can download the Vouchers directly as a PDF and print them out yourself (Print@Home) or have them sent to you in printed form. Orders are normally processed within 48 hours and sent by A Mail to the address provided. For printed Vouchers, shipping costs will be charged per order as specified at the end of the order process.

Vouchers will not be replaced in the event of loss or theft.

Vouchers or tickets whose barcode or QR code has become illegible lose their validity. However, you can print them out again in your personal guest account.

Should duplicates or fraudulent actions occur (which may result in a report to the authorities), AQUA-SPA-RESORTS reserves the right to reject all affected Vouchers or tickets and refund the purchase price to the rightful holder only.

You can set up your own guest account on the website. There you have the option of loading money into your account and using it to pay for AQUA-SPA-RESORTS services. Your credit will expire if your guest account has not been used for 10 years.

You can pay for online orders by credit card, Twint, PayPal or Postcard.

You can pay on site in all Spa Worlds by credit card, Twint, PayPal, Postcard, cash (CHF/EUR) or by prepayment. Please note that only cashless payments are possible at Hürlimannbad & Spa Zürich.

Credit card billing takes place via Worldline Schweiz AG (Saferpay). All items and Vouchers remain the property of AQUA-SPA-RESORTS until full payment has been made. The offers and services of AQUA-SPA-RESORTS will only be provided after payment has been made.

The amount for annual subscriptions is due immediately upon conclusion of the contract or upon renewal.

AQUA-SPA-RESORTS reserves the right to deny you access to the Spa World if payment is outstanding, to charge reminder fees and to take legal action. You are not entitled to a refund or credit for usage times that you have missed due to your late payment.

You pay for additional services and consumptions when you leave the spa world at the cash desk.

Use of the spa worlds of the AQUA-SPA-RESORTS is at your own risk and peril. Neither AQUA-SPA-RESORTS nor its employees or assistants accept any liability for damage resulting from accidents, injuries or illnesses.

AQUA-SPA-RESORTS is not liable for the loss of valuables, money, clothing, chip bracelets etc.. We also accept no liability for items deposited at reception. It is your responsibility to take out appropriate insurance.

If you take part in courses, AQUA-SPA-RESORTS accepts no liability if you fail to disclose physical or mental complaints for which participation in a course would not be advisable. Likewise, there are no liability claims against you if health problems arise as a result of participating in the course. You are responsible for ensuring that you have adequate insurance cover. AQUA-SPA-RESORTS reserves the right to refuse participants if, in the opinion of the course management, the health or psychological requirements for participation are not met. This refusal can also be issued at short notice or during an ongoing course.

Should consequential damage occur despite professional application because you have concealed reasons for exclusion, the therapist is exempt from any liability. The same applies if you were not aware of the reasons for exclusion and these were not recognisable to the therapist.

AQUA-SPA-RESORTS accepts no liability for the accuracy, completeness and reliability of the information provided on the website. AQUA-SPA-RESORTS accepts no liability for damage caused by transmission errors, technical defects, operational failures or unlawful interference with IT systems, irrespective of the location and type of impairment. Liability is also excluded in the event of malfunctions, interruptions (including system-related maintenance work) or overloading of IT systems. AQUA-SPA-RESORTS shall not be liable for direct or indirect damage (consequential damage) arising in connection with the retrieval of services or information on the website.

The information published on the website is for your private use only and to inform potential guests. You are aware that this information may be changed at any time and without prior notice.

The entire content of the AQUA-SPA-RESORTS website is protected by copyright. You may only download or print out individual pages or sections of the website if all copyright notices and other protected designations are retained.

Even if you download or otherwise reproduce content, all rights to the information remain with AQUA-SPA-RESORTS. Commercial use of the website, the images or parts thereof is generally not permitted.

AQUA-SPA-RESORTS processes your personal data in accordance with the applicable data protection laws and in accordance with the data protection declarations published on the websites.

Guest data may be managed by an external service provider. In this case, your personal data will only be passed on to this service provider for processing.

The GTC and the house and bathing rules apply in the version valid at the time of your booking or purchase. AQUA-SPA-RESORTS reserves the right to unilaterally amend the GTC and the house rules at any time.

Should a provision of these GTC be or become void or invalid, the remaining part of the GTC shall remain unaffected. Void or invalid provisions shall be replaced by provisions that come closest to the economic purpose. The same applies if there is a gap in the contract or if a provision proves to be unenforceable.

The following places of jurisdiction apply to all disputes and all present and future claims arising from or in connection with the contract between you and AQUA-SPA-RESORTS:

• The ordinary courts in Zurich have exclusive jurisdiction for legal relationships with AQUA-SPA-RESORTS AG Thermal bath & Spa.
• The ordinary courts in Sursee have exclusive jurisdiction for legal relationships with AQUA-SPA-RESORTS AG.

All legal relationships with AQUA-SPA-RESORTS and its offers are subject exclusively to substantive Swiss law.

AQUA-SPA-RESORTS may transfer its rights and obligations under this contract to a legal successor. By accepting these general terms and conditions, you give your consent to this.
